In Malta, freedom of information is contemplated in two distinct fundamental freedoms’ enactments. The first is contained in article 41 of the Constitution of Malta and the second in Article 10 of the First Schedule to the European Convention Act, 1987.

What does environmental information include?

Environmental information includes any information on the state of the elements of the environment, such as air and atmosphere, water, soil, land, landscape and natural sites including wetlands, coastal and marine areas, biological diversity and its components, including genetically modified organisms, and the interaction among these elements. Energy, noise, radiation or waste, including radioactive waste, emissions, discharges and other releases into the environment, including also policies, legislation, plans, programmes, environmental agreements, and activities related to them, which affect or likely to affect the elements of the environment shall also be considered as environmental information.

Reports on the implementation of environmental legislation and the state of human health and safety, including the contamination of the food chain, conditions of human life, cultural sites and built structures shall also be considered as environmental information as held out in Legal Notice 116 of 2005.
