Malta offers a unique citizenship pathway for American entrepreneurs, technologists, and philanthropists seeking a prestigious second citizenship in a secure European country. Since July 2025, Malta has widened its 2017 Citizenship by Merit provisions and has replaced the 2020 Exceptional Services by Investment rules with regulations that describe the merit-based pathway to citizenship, consistent with EU law and Malta’s Vision 2050.

This publication outlines the legal framework, residency requirements, recognised contributions, and practical U.S. considerations (including tax and dual citizenship). It also includes case examples that illustrate how American applicants can successfully align their contributions with Malta’s national priorities.

Maltese Citizenship pathways for U.S. families, technologists, entrepreneurs, and philanthropists

  • Citizenship by Merit recognises exceptional contributions and exceptional services of national interest.
  • Applicants must establish legal residence in Malta for at least 8 months before applying.
  • Rigorous due diligence and evaluation apply to all applications.
  • Dual nationality is permitted under Maltese and U.S. law.

Why Americans seek a Second Citizenship

For many Americans, a second passport offers benefits that go beyond mere travel convenience. A second passport can unlock new opportunities for investment, education, eligibility for sports competitions, and healthcare in other countries.

Malta’s citizenship provides U.S. nationals with expanded global mobility, tax compliant US-Malta structures, and enhanced lifestyle options. As a member of the European Union, Malta grants passport holders visa-free or visa-on-arrival access to over 190 countries, including all EU and Schengen countries. For Americans interested in travel, business, or establishing a home in Europe, Maltese citizenship provides unrestricted access to live, work, and study within the EU.

Alternatives Citizenship Routes for Americans

While all countries in Europe, and beyond, allow citizenship by naturalisation, this often takes anywhere between 6 to 10 years of continuous living in the host country. Malta is the only residency route that leads to citizenship by merit in as little as 15 months by recognising significant contributions by reputable individuals and families, after establishing in Malta ties that are appropriate to the applicant's family profile and circumstances. For many Americans, this means physical presence for a few days combined with strong personal, commercial and investment ties with Malta, that vary with the family's personal, professional and business profile.

While most European countries allow citizenship by naturalisation, this typically requires 6 to 10 years of continuous lawful residence, integration, and language proficiency.

Malta provides an alternative through citizenship by merit, under which reputable individuals and families who establish appropriate ties to Malta and demonstrate an exceptional contribution aligned with national priorities may be considered for naturalisation after eight months of legal residence. The framework is discretionary, merit-driven, and assessed on a case-by-case basis.

For many Americans, this does not necessarily require permanent relocation. Rather, it involves establishing personal, commercial, philanthropic, or investment ties proportionate to the applicant’s family and professional profile, with physical presence assessed holistically.

Why Malta Appeals Specifically to American Families

Malta combines EU membership with an English-speaking, Commonwealth-influenced legal system, reducing linguistic and legal friction for U.S. nationals.

It also maintains a clear distinction between citizenship, residence, and tax residence, an important structural feature for Americans subject to worldwide U.S. taxation and, with our US-Malta tax planning advice, Maltese citizenship need not have tax implications in the US or in Malta.

Finally, Malta’s merit-based framework recognises contribution and national interest alignment, a philosophy that often resonates with entrepreneurial and philanthropic American families seeking durable European optionality rather than simple relocation.

Why Maltese Citizenship appeals to Americans

Malta has become a natural choice for American nationals considering a European residence or citizenship base. For Americans seeking a second citizenship in Malta, some of the most attractive options include citizenship through Maltese descent and citizenship granted on merit for exceptional services or contributions to Malta.

Americans getting Maltese Citizenship look for the following advantages:

  • English is an official language: English is the language of government correspondence, the language used in educational institutions and is very widely spoken than the native Maltese language, due to a very mixed population.
  • Strategic Location: Centrally located between Europe, North Africa, and the Middle East, Malta is ideal for entrepreneurs seeking global connectivity.
  • High Quality of Life: Malta offers a stable political climate, excellent healthcare, and U.S.-style and international education options, and a Mediterranean lifestyle, making it an ideal place to live and raise a family.
  • Legal Stability: A robust legal framework, stable political system, and EU membership ensure certainty and rule of law.
  • Visa-Free Travel: Maltese citizenship grants visa-free access to over 190 countries, including the EU, US, UK, and Canada.
  • Investment Opportunities: Maltese citizenship allows access to investment opportunities in Malta and throughout the EU.
  • LGBTIQ Friendly: Malta is known for its progressive stance on LGBTIQ rights, ranking highly on the ILGA Rainbow Europe Map and ensuring equality and protection for the LGBTIQ community.
  • Dual Citizenship: Maltese law allows for dual nationality or even the holding of multiple citizenships, without the need to give up or renounce US citizenship upon acquiring Maltese citizenship.

The Maltese are renowned for their hospitality and strong sense of community, which extends to foreigners, making newcomers quickly feel part of the community. Additionally, Malta's dynamic and diverse culture, coupled with its strong sectors such as tourism, real estate, and gaming, provides ample business opportunities.

The unprecedented geopolitical developments of recent years have had a significant impact on the demand for the Maltese Citizenship. This surge in demand is evident from the growing number of inquiries and applications for Maltese citizenship. Maltese Citizenship applications have seen a steady increase in interest from high-net-worth individuals and families looking to secure their future in a stable and prosperous country. Malta's rigorous due diligence process ensures that only reputable individuals are granted citizenship.

Legal Basis for Citizenship by Merit in Malta

The merit-based route is firmly rooted in law. It is established under the Maltese Citizenship Act(Cap. 188 of the Laws of Malta), as amended by the Maltese Citizenship (Amendment) Act, 2025 (Act XXI of 2025), and implemented by the Granting of Citizenship for Exceptional Services by Merit Regulations, 2025 (Legal Notice 159 of 2025).

Article 10(9) of Cap. 188 provides:

“The Minister may also grant a certificate of naturalisation to any person who has rendered exceptional services to the Republic of Malta or whose naturalisation is otherwise of exceptional interest to the Republic of Malta.”

The 2025 amendments expanded the definition of exceptional services or contributions, introducing a transparent evaluation mechanism through the Evaluation Committee, and requiring all contributions to be assessed against Malta’s national interest and Vision 2050 development strategy.

Exceptional Services or Contribtions qualifying as Merit

Unlike the earlier investment-driven framework, citizenship by merit does not rely on fixed financial thresholds.Instead, it emphasises qualitative contributions that advance Malta’s long-term priorities. Recognised categories include:

  • Innovation & Technology: Establishing research centres in AI, Med Tech, or fintech.
  • Entrepreneurship & Job Creation: Creating high-value employment or transferring knowledge-intensive industries.
  • Philanthropy: Funding education, health, or social initiatives with measurable community impact.
  • Science & Research: Advancements in climate resilience, public health, or academia.
  • Culture & Sports: Supporting cultural heritage projects or sports excellence that enhance Malta’s international profile.

All applicants must undergo rigorous due diligence, with proposals evaluated for sustainability, impact, and alignment with Malta’s Vision 2050.

Example 1 – Technology & Education

A U.S. entrepreneur makes a substantial donation to a university scholarship fund for AI research, while establishing a local MedTech company employing 10 people over the next 5 years.

Example 2 – Healthcare & Philanthropy

An American family office funds oncology upgrades at Mater Dei Hospital, while co-founding a telehealth company that connects U.S. specialists with Maltese patients.

Example 3 – Sustainability & Energy

An American philanthropist supports a marine biodiversity initiative, while investing in solar microgrid solutions for Gozo communities.

These examples illustrate the dual merit model: combining philanthropy with sustainable enterprise.

Requirements to Obtain Citizenship in Malta

U.S. nationals applying for citizenship through merit, can obtain citizenship through a combination of residency requirements and merit, allowing them to establish a deep connection with Malta.

To be eligible for Malta Citizenship by Merit, the main applicant must:

  • Main Applicant to be at least 18 years of age.

Citizenship Application Process for Americans

Americans applying for Maltese citizenship through merit enjoy a structured and well-regulated process. Here is a simplified overview of the steps:

  1. Pre-Application & Due Diligence: We help applicants gather necessary documentation and perform preliminary background checks.
  2. Residency Application: Applicant must visit Malta and submit a residency application.
  3. Merit Proposal: We help you draft a proposal letter to the Evaluation Board, including the background of the applicant, the proposed contribution or service to Malta and a post-naturalisation plan.
  4. Initial Due Diligence: The Community Malta Agency reviews completeness of the proposal letter and conducts due diligence on the applicant before sending the proposal to the Evaluation Board for assessment.
  5. Evaluation Board Assessment: The Evaluation Board reviews the proposal and recommends acceptance or rejection. Should the proposal be accepted, a Letter of Approval In Principle is issued.
  6. Citizenship Application: A citizenship application is submitted at this stage with proof of title to a property and evidence of contribution made or to be made. Further due diligence checks are done at this stage.
  7. Final Approval: The Evaluation board conducts confirmation of investment and recommends the application for approval to the Minister. Within six months the applicant is required to take an Oath of Allegiance. Post naturalisation the agency continues monitoring any commitments pledged by the applicant.

I engaged Chetcuti Cauchi to transition my citizenship by investment process, started before the ECJ decision, to the new Citizenship by Merit laws in Malta. Partners Jean-Philippe Chetcuti, Priscilla Mifsud-Parker, and Antoine Saliba-Haig inspired confidence in their extensive experience from the first conversations, which confirmed my decision to work with a local specialist law firm. JP, Priscilla and Antoine stayed involved throughout the case right to completion, in a process that clearly needed senior legal attention. I am now a proud Maltese citizen, having moved from the US to Malta with my family. I'm in love with Malta, the Mediterranean lifestyle, the inclusivity and above all, the warm people I now form part of.
