Legal Basis for Citizenship by Merit in Malta

It is established under the Maltese Citizenship Act(Cap. 188 of the Laws of Malta), as amended by the Maltese Citizenship (Amendment) Act, 2025 (Act XXI of 2025), and implemented by the Granting of Citizenship for Exceptional Services by Merit Regulations, 2025 (Legal Notice 159 of 2025).

Article 10(9) of Cap. 188 provides:

“The Minister may also grant a certificate of naturalisation to any person who has rendered exceptional services to the Republic of Malta or whose naturalisation is otherwise of exceptional interest to the Republic of Malta.”

The 2025 amendments expanded the definition of exceptional services or contributions, introducing a transparent evaluation mechanism through the Evaluation Committee, and requiring all contributions to be assessed against Malta’s national interest and Vision 2050 development strategy.

Exceptional Services or Contribtions qualifying as Merit

Unlike the earlier investment-driven framework, citizenship by merit does not rely on fixed financial thresholds.Instead, it emphasises qualitative contributions that advance Malta’s long-term priorities. Recognised categories include:

  • Innovation & Technology: Establishing research centres in AI, Med Tech, or fintech.
  • Entrepreneurship & Job Creation: Creating high-value employment or transferring knowledge-intensive industries.

Requirements to Obtain Citizenship in Malta

  • Main Applicant to be at least 18 years of age.
  • Applicant must take an Oath of Allegiance to the Republic of Malta.

  • Submit a medical examination report attesting to good health and absence of contagious diseases.
  • Provide a police conduct certificate from each country of citizenship, and each country where the applicant has lived for more than 6 months in the last 10 years.
  • Provide evidence of a clean source of wealth and funds.
  • Hold a residence permit in Malta at the time of application.

Citizenship Application Process for Americans

  1. Pre-Application & Due Diligence: We help applicants gather necessary documentation and perform preliminary background checks.
  2. Residency Application: Applicant must visit Malta and submit a residency application.
  3. Merit Proposal: We help you draft a proposal letter to the Evaluation Board, including the background of the applicant, the proposed contribution or service to Malta and a post-naturalisation plan.
  4. Initial Due Diligence: The Community Malta Agency reviews completeness of the proposal letter and conducts due diligence on the applicant before sending the proposal to the Evaluation Board for assessment.
  5. Evaluation Board Assessment: The Evaluation Board reviews the proposal and recommends acceptance or rejection. Should the proposal be accepted, a Letter of Approval In Principle is issued.
  6. Citizenship Application: A citizenship application is submitted at this stage with proof of title to a property and evidence of contribution made or to be made. Further due diligence checks are done at this stage.
  7. Final Approval: The Evaluation board conducts confirmation of investment and recommends the application for approval to the Minister. Within six months the applicant is required to take an Oath of Allegiance. Post naturalisation the agency continues monitoring any commitments pledged by the applicant.
